1. GENERAL PROVISIONS
This Privacy Policy and Personal Data Protection Policy (hereinafter referred to as the “Policy”) has been developed by Global Transport Investments LLC (EDRPOU code 31368237, Odesa, Ukraine), hereinafter referred to as the “Administrator” or “Data Controller”, in accordance with the applicable legislation of Ukraine, in particular the Law of Ukraine “On Personal Data Protection”, as well as taking into account the requirements of Regulation (EU) 2016/679 (GDPR).
Please read this Policy carefully. It governs the procedure for the collection, use, and protection of data of Users of the website operating under the .com domain (hereinafter referred to as the “Website”). By submitting a request for logistics services, subscribing to newsletters, or using the tools of the Website, the User provides explicit consent to the processing of their Data under the terms set forth below.
The Website is operated by the GTI Group (Global Transport Investments). The main data controller is GTI Global Transport Investments. Depending on your location, regional offices may act as joint controllers and data processors, including Formag Odesa, Kyiv, Lviv (Ukraine), Formag Poland (EU), Formag Vietnam (Asia), and other affiliated entities.
The Company treats the confidential information of all individuals who visit the Website with the utmost respect. We strive to create the most comfortable and secure environment for using our services. This Policy defines the procedures for processing personal data, the types of data collected, the purposes of their use, interaction with third parties, and the security measures applied.
2. DEFINITIONS
Personal Data Database – a named set of organized personal data in electronic form and/or in the form of personal data filing systems.
Owner of the Personal Data Database – a natural or legal person who, pursuant to law or with the consent of the personal data subject, is granted the right to process such data, who determines the purpose of processing personal data in the database, establishes the scope of such data and the procedures for their processing, unless otherwise provided by law.
Consent of the Personal Data Subject – any documented, voluntary expression of will of an individual granting permission for the processing of their personal data in accordance with the defined purpose of such processing.
Anonymization of Personal Data – the removal of information that enables the identification of an individual.
User – a legally capable natural person (including but not limited to a citizen of Ukraine, a foreign national, a stateless person, or an individual entrepreneur), or a legal entity acting through an authorized representative, who seeks to obtain information about logistics services.
Cookies – small text files stored on the User’s device when visiting the Website.
Joint Controllers – affiliated entities and regional offices of the Formag network (Ukraine, Poland, Vietnam), as well as other partners involved in ensuring the execution of the logistics chain.
Logistics Services – freight forwarding, chartering, customs clearance, and related operations.
WIPO (World Intellectual Property Organization) – an international organization that confirms the protection of the Administrator’s trademarks at the global level.
3. SOURCES AND CATEGORIES OF PERSONAL DATA
We take full responsibility for protecting the data collected about Website visitors against loss, unauthorized use, and alteration. Employees of the Company undertake not to disclose to third parties or distribute any information about the Company’s clients obtained in the course of their work, including information related to Website visitors.
The following categories of personal data may be collected, stored, and used:
- Information about your computer, including your IP address, geographical location, browser type and version, and operating system;
- Information about your visits to and use of this Website, including referral sources, duration of visits, pages viewed, and website navigation paths;
- Information such as your name and email address, which you provide when subscribing to our mailing lists, submitting inquiries, or contacting us via the Website;
- Information generated through the use of our Website, including data on the time, frequency, and conditions of its use;
- Information contained in any communications you send to us through the Website, including the content of such messages and related metadata.

• Conclusion and performance of freight forwarding agreements;
• Provision of current transportation rates (which do not constitute a public offer within the meaning of Article 641 of the Civil Code of Ukraine);
• Ensuring technical support of the Website and prevention of cyber threats;
• Marketing communications, subject to obtaining the User’s consent through a hard opt-in mechanism.
5. USE OF COOKIES
Cookies are text files stored on your device. We use the following categories of cookies:
• Strictly Necessary Cookies: Required for navigation across pages, registration, and authentication. These cookies are configured with Secure and HttpOnly attributes.
• Performance Cookies: Aggregate information on how the Website is used (such as time spent and frequently visited pages) for statistical purposes.

• Targeting Cookies: Used to deliver content that may be of interest to you and to manage advertising.

The Company is not responsible for the privacy policies or data protection practices of external resources that may be linked to on the Website.
Disclosure of Personal Information
We reserve the right to disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers, or subcontractors, to the extent and for the purposes set out in this Policy.
We also reserve the right to disclose your personal information:
1. where required to do so by law;
2. in connection with any ongoing or prospective legal proceedings;
3. for the purpose of establishing, exercising, or defending our legal rights (including providing information to other parties for the purposes of fraud prevention or credit risk reduction).
We will not disclose your personal information to third parties except in the cases specified in this Policy.
7. RIGHTS OF THE PERSONAL DATA SUBJECT (DSAR)
You have the right to:

- Access your personal data and obtain information regarding their processing;
- Request the rectification or erasure of personal data if such data are processed unlawfully;
- Withdraw your consent to the processing of personal data;
- Be protected against automated decision-making, including profiling, that produces legal effects concerning you or similarly significantly affects you.
We undertake to respond to your Data Subject Access Request (DSAR) within 30 days from the date of receipt.

8. DATA PROTECTION AND SECURITY
The Company applies generally accepted technological security standards to protect information.
Access to data is granted only to authorized employees who have entered into confidentiality obligations.
The Website is not intended for use by minors.
9. INTELLECTUAL PROPERTY AND LIABILITY
All content of the Website is the property of Global Transport Investments LLC.
The Administrator is the lawful owner of the following trademarks registered in Ukraine (UkrNOIVI) and at the international level (WIPO):

Formag Forwarding (No. 1877216), Formag (No. 1756068), as well as a figurative trademark in the form of stylized letters “ff” (No. 1877218), with legal protection in the EU countries, Georgia, Uzbekistan, Azerbaijan, Kazakhstan, Moldova, and Vietnam. - National registrations (Ukraine):
GTI (No. 97321), Formag Forwarding (No. 120965), Formag Group (No. 120964), Formag Agencies (No. 120967), Formag Logistics (No. 128316), Silk Route Shipping (No. 315136), MET (No. 334127), Via multima (No. 120966), Formag (No. 359656), Формаг (No. 360825).
Any use of the above-mentioned trademarks without the prior written consent of the rights holder is strictly prohibited.
Automated data collection (scraping) of the Website’s content and databases is strictly prohibited.
10. CHANGES TO THE POLICY
This Policy may be amended from time to time. In the event of material changes, the Company will post a notice on the Website. Continued use of the Website after such changes have been made constitutes your acceptance of the updated Policy.

These Terms of Use (hereinafter referred to as the “Terms”) govern access to and use of the website of the GTI Group (Global Transport Investments) (hereinafter referred to as the “Website”). By accessing this Website, you (hereinafter referred to as the “User”) agree to be bound by these Terms in full. If you do not agree with any provision of these Terms, you must immediately discontinue use of the Website.
1. GENERAL PROVISIONS AND WEBSITE OWNER
1.1. The Website is operated by GTI Global Transport Investments and its affiliated entities.
1.2. The Website serves as a platform for providing information about transportation and logistics services, calculating indicative freight rates, and communicating with clients.
2. INTELLECTUAL PROPERTY
2.1. All materials available on the Website, including but not limited to texts, photographs, source code, and logos, are protected by copyright and are the intellectual property of the GTI Group.
2.2. Trademark Status
The User acknowledges that Global Transport Investments LLC (Ukraine, EDRPOU code 31368237) is the exclusive owner of the rights to the following trademarks:
- Global protection (WIPO): Trademarks Formag Forwarding (IR No. 1877216), Formag (IR No. 1756068), and the “ff” logo (IR No. 1877218). Legal protection extends, inter alia, to the territory of the European Union and countries of the Asia-Pacific region.
- Local protection (Ukraine): GTI, Formag Forwarding, Formag Group, Formag Agencies, Formag Logistics, Silk Route Shipping, MET, Via multima, Formag, Формаг.
2.3. Any use of logos, names, or designations that are identical or confusingly similar to the above-mentioned trademarks for commercial purposes or for the creation of competing services shall result in liability in accordance with international law and the legislation of Ukraine.
3. RESTRICTIONS AND PROHIBITIONS
The User is strictly prohibited from:
- Using any automated devices, programs, algorithms, or methods (including, but not limited to, scraping, crawling, or data mining) to access, copy, or monitor any part of the Website;
- Engaging in any actions aimed at disrupting the stable operation of GTI servers or circumventing security systems;
- Using the Website to distribute spam, viruses, or any malicious software;
- Copying the Website content for the purpose of creating similar services or competing logistics platforms.
4. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
4.1. Logistics Information
Any freight calculators, vessel schedules, transit times, and rates displayed on the Website are provided for informational purposes only. They do not constitute a public offer within the meaning of Article 641 of the Civil Code of Ukraine or under international law.
4.2. Official Offer
Only a formal written confirmation (Booking Confirmation / Quote) issued by an authorized manager of the relevant division (Liner or Freight Forwarding Division) shall constitute a legally binding offer.
4.3. The Company shall not be liable for any direct or indirect losses (including loss of profit) arising from the use of information contained on the Website or from the temporary unavailability of the Website.
5. PRIVACY AND COOKIES
5.1. The procedures for the collection and processing of your personal data are described in detail in our Privacy Policy and Personal Data Protection Policy.
5.2. Use of the Website constitutes your consent to the use of cookies under a hard opt-in model (except for technically necessary cookies).
6. GEOGRAPHICAL SCOPE AND GOVERNING LAW
6.1. The Website is intended for a global audience (domain .com).
6.2. For Users located in Ukraine, legal relations shall be governed by the laws of Ukraine. Any disputes shall be subject to the jurisdiction of the competent courts of Ukraine.
6.3. For international Users, the law of the country of registration of the GTI head office shall apply, unless otherwise required by mandatory rules of international private law.
7. MODIFICATION OF THE WEBSITE AND THE TERMS
The Company reserves the right, at any time and without prior notice, to:
- Modify the content of the Website and applicable rates;
- Amend these Terms (the updated version shall enter into force upon publication);
- Restrict or terminate User access to certain sections of the Website in the event of a breach of these Terms.
